Court Battles Waged on the First Amendment Front

The federal court in Philadelphia extended the temporary restraining order against the Child Online Protection Act ("CDA II") until February 1, 1999, delaying the preliminary injunction hearing until January 20-22, 1999. In another major court decision, a federal judge struck down the mandatory filtering policy of the Loudon County, VA library system. The court found that mandatory filtering "impermissibly discriminates against protected speech on the basis of content and constitutes an unconstitutional prior restraint." In California, Judge John Lewis of the Sacramento Superior Court issued a temporary injunction ordering a former Intel employee to halt mass mailings to company e-mail lists, in a decision with implications for both privacy and first amendment rights in the workplace.
