AMENDMENT TO S.1619 INTENDED TO BE PROPOSED BY MR. BURNS:


Strike page 2, line 1, and all that follows through page 4, line 4, and insert the following:

SECTION 1. NO UNIVERSAL SERVICE FOR SCHOOLS OR LIBRARIES THAT FAIL TO ADOPT OR IMPLEMENT INTERNET USE POLICIES LIMITING ACCESS BY MINORS TO INAPPROPRIATE MATTER.

(a) PROHIBITION.--Section 254 of the Communications Act of 1934 (47 U.S.C. 254) is amended by adding at the end the following:

"(1) INTERNET USE POLICIES TO RESTRICT ACCESS BY MINORS TO INAPPROPRIATE MATTER.--

"(1) IN GENERAL.--No services may be provided under subsection (h)(1)(B) to any elementary or secondary school, or any library, unless it provides the certification required by paragraph (2).

"(2) CERTIFICATION.--Before receiving universal service assistance under subsection (h)(1)(B), an elementary or secondary school (or the school board or other authority with responsibility for administrations of that school), or a library, shall certify to the Commission that it has adopted or implemented a policy for the use of the Internet that is intended to prevent access by minors to inappropriate matter on the Internet.

"(3) LOCAL DETERMINATION OF CONTENT.--

"(A) DETERMINATION.--For purposes of paragraph (2), the determination of what matter is inappropriate for minors shall be made by the school, school board, library or other authority responsible for making the required certification.

"(B) PROHIBITION ON CERTAIN FEDERAL ACTIONS.--No agency or instrumentality of the United States Government may--

"(i) establish criteria for making a determination described in subparagraph (A);

"(ii) review the determination made by the certifying school, school board, library, or other authority; or

"(iii) consider the criteria employed by the certifying school, school board, library, or other authority in the administration of subsection (h)(1)(B).

"(5) APPLICABILITY.--This subsection shall apply to the provision of services under subsection (h)(1)(B) after December 31, 1998.".

Amend the title so as to read: "To require schools and libraries that receive universal service assistance to adopt Internet use policies that restrict access by minors to matter inappropriate for minors on the Internet, and for other purposes.
