Privacy Enforcement

When Congress enacted HIPAA, it included civil and criminal penalties for failure to comply with the statute, and these penalties applied to the subsequent Privacy and Security Rules that took effect in 2003.  Unfortunately, to date the HIPAA rules have not been adequately enforced.  Recent legislation provides opportunities for enhanced enforcement, but more work is needed.
