Consent

Individuals should be given the opportunity to make meaningful, informed choices about how their personal health information is accessed, used, and disclosed.  But consent is not the linchpin of privacy, and overreliance on notice and consent in practice provides weak privacy protection.  Most critical to privacy is a comprehensive framework of rules governing how information is accessed, used, and disclosed which protects information without regard to consent.
