Proposed Mark for Sexually Oriented Spam Overbroad and Unconstitutional, CDT Argues - In comments filed at the Federal Trade Commission, CDT argued that marking sexually oriented spam with a label that would facilitate ISP filtering would unconstitutionally burden senders of legal material. Under the CAN-SPAM Act of 2003, the FTC is required to issue a regulation specifying a mark to be added to all unsolicited commercial e-mail containing sexually oriented material, including material that is not obscene.
