FCC Spectrum Rules Include Partial Openness Conditions - The FCC today approved rules for auctioning wireless spectrum in the 700 MHz band. As CDT has observed, this spectrum offers a rare opportunity to expand competition in the broadband market. The full text of the rules is not yet public, but reportedly they include a requirement that 22 MHz of the spectrum (about a third) be operated in a manner that permits consumers to use third-party devices and applications. Unfortunately, the rules apparently do not require any of the spectrum to be made available on a wholesale basis, as CDT, other public interest advocates and some private companies had urged.
